What compensation can a Lyft or Uber passenger get after a car accident?
Lyft and Uber passengers who are injured can file claims seeking compensation for the injuries they suffered, including medical expenses, property damage, lost income, pain and suffering. The amount of compensation that an injured passenger may be entitled to receive depends on the facts of their case.
What Lyft or Uber injury cases do our car accident attorneys handle?
Our car accident lawyers can represent drivers and passengers involved in accidents with:
- Lyft collisions where the driver was negligent
- Uber accidents with another vehicle or object
- Accidents when the Lyft/Uber driver was not at fault
- Lyft/Uber drivers who were hit by a careless driver while waiting for pick ups or drop offs that failed to see them, or while driving a passenger.
Uber and Lyft Accident Insurance
Lyft and Uber generally require their drivers to carry auto insurance for the vehicles they use. Drivers are required to have bodily injury liability insurance, which provides coverage for injuries passengers may suffer in the event of an accident. They may also offer its drivers collision damage waiver, or CDW, protection.
What are Florida’s ride sharing laws?
Florida has made various changes to its traffic laws that can affect Lyft/Uber accidents including:
1. Automobile insurance that provides:
a. A primary automobile liability coverage of at least $50,000 for death and bodily injury per person, $100,000 for death and bodily injury per incident, and $25,000 for property damage; b. Personal injury protection benefits that meet the minimum coverage amounts required under ss. 627.730-627.7405; and c. Uninsured and underinsured vehicle coverage as required by s. 627.727.
If it is a prearranged ride, Florida law generally requires automobile insurance that provides:
a. A primary automobile liability coverage of at least $1 million for death, bodily injury, and property damage; b. Personal injury protection benefits that meet the minimum coverage amounts required of a limousine under ss. 627.730-627.7405; and c. Uninsured and underinsured vehicle coverage as required by s. 627.727.
Examples of when a Lyft or Uber passenger may have a claim for compensation include:
If a Lyft or Uber driver’s car is hit by another car while it is driving to pick up a passenger, the Lyft/Uber driver may be able to bring a claim for compensation against the at fault party.
Florida Lyft/Uber drivers who get in an accident while on duty may be able to pursue a liability claim against the vehicle who was responsible for the crash, and a claim for uninsured or underinsured motorist coverage benefits if the at-fault party did not have liability insurance or enough insurance to fully compensate the driver.
An injured Lyft/Uber passenger may be able to file a claim against the Lyft/Uber driver if the Lyft/Uber driver was acting negligent while driving and caused an accident that injured the passenger.
