The Life Insurance Suicide Clause
Most life insurance policies contain a clause which disclaims or avoids coverage if the insured commits suicide during a certain period of time. Some policies will not pay benefits if the insured kills himself or herself during the policy period, and other policies will not pay benefits if the insured commits suicide during the first two years that the policy is in effect.
Suicide May Not Void Coverage
There are several ways to have coverage apply, even if an insured allegedly commits suicide. If the life insurance policy has a two-year limit to the suicide exclusion, then the policy may still get paid out in full if the insured commits suicide more than two-years after the policy went into effect. An insurance agent once joked, “If you are going to kill yourself, just wait two years and a day.”
The Insurance Company May Have To Prove It Was Suicide
You may still be entitled to full benefits if the insurance company cannot prove that the insured’s death was by suicide. Suicide is not easy for an insurance company to prove. For example, someone found hanging could have been engaged in auto-erotic asphyxiation and accidentally hung himself, with no actual intention of committing suicide. There have also been cases of staged suicide, but may have been murder. In those cases, the suicide exclusion may not apply and full benefits may be awarded.
